Apply for a street seat permit

The Portland Bureau of Transportation (PBOT)’s Portland in the Streets program issues Street Seat Permits for structures or platforms built in on-street parking spaces to help activate the public space. You can use them as additional seating for your restaurant or for public use.

This application can take up to 30 minutes to complete. Additional materials may take longer to prepare. After we receive an application, it may take from one to two months to issue a permit. Determine the type of Street Seat Permit below, fees vary.

  1. Choose a location

    Please read the location guidelines and choose a location that meets the requirements. Please contact us if you have questions.

  2. Determine if your street seat is for public use or café seating

    Public use: best for people who are not profiting from the use of the space.  

    Café Seating: best for businesses who want to expand their café seating to the outdoors. This may require you to also have a sidewalk café permit.

  3. Gather neighborhood and adjacent property owner support

    Street seats need to have support from the adjacent property owner as well as proof of support from the local neighborhood and business associations.

  4. Complete the application

    Application packet requirements:

    • Design - create and prepare detailed design plans of the structure, including; materials being used, dimensions, etc. If you already have sidewalk seating include that in the designs.
    • Location proposal - a street seat must meet the location requirements outlined in the Street Seat Program Guidelines. 
    • Confirm support from adjacent property owner, with signature.
    • Propose a maintenance plan - describe how you plan on maintaining the street seat’s condition.
    • Proof of neighborhood and business support. 
    • $100 application fee. 

    Include the required insurance documents with your application. We require you to submit a certificate of insurance and an endorsement naming the City of Portland as additionally insured. For more information, read insurance and bond requirements for permits in the right-of-way.

  5. Wait for processing and review

    • A preliminary inspection will take place. This inspection will determine whether the location is fit for your street seat. 
    • A City Engineer will review your designs and site proposals. PBOT will contact you with any issues.  
    • PBOT will notify neighboring business and properties of your street seat proposal. We will gather any feedback from your neighborhood for a two-week period. 
  6. Pay for your permit and begin building the street seat
